General Terms and Conditions and Customer Information

§ 1 Basic Provisions

(1) Die nachstehenden Geschäftsbedingungen gelten für Verträge, die Sie mit uns als Anbieter (MycoVital Gesundheits GmbH) über die Internetseite www.mycovital.de schließen. Soweit nicht anders vereinbart, widersprechen wir der Einbeziehung Ihrer AGB.

(2) A consumer is any natural person who concludes a legal transaction for private purposes. An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their independent or commercial activity.

§ 2 Conclusion of the Contract

(1) The subject of the contract is the sale of goods.

(2) By placing a product on our website, we submit a binding offer to conclude a contract via the online shopping cart system under the conditions stated in the offer.

(3) The contract is concluded as follows:

• Goods are collected in the “shopping cart” and can be edited there.
• After clicking on “Checkout” or “Continue to order” and entering your data, an order overview appears.
• With instant payment systems (e.g. PayPal, Amazon Pay, Sofort), you will be redirected to the payment provider. You will then see the order overview.
• Before submitting the order, you have the option to check, change or cancel it at any time.
• By clicking on “order with obligation to pay”, you accept the offer in a legally binding manner and the contract is concluded.

(4) Inquiries regarding individual offers are non-binding. You will receive a binding offer in text form (e.g. email), which you can accept within 5 days.

(5) The order processing and transmission of all necessary information takes place via email (partially automated). Please ensure that your email address is correct and that receipt is not hindered by SPAM filters.

§ 3 Contract Duration / Termination of Subscription Contracts

(1) Subscription contracts run for an indefinite period and can be terminated by either party with one month’s notice to the end of the month.

(2) The right to terminate without notice for good cause remains unaffected.

(3) The termination must be made in text form (e.g. email) or via the online termination function.

§ 4 Special Agreements on Payment Methods

(1) SEPA Direct Debit

By issuing a SEPA mandate, you authorize us to collect the invoice amount from the specified account. The collection takes place 7–14 days after the conclusion of the contract. The pre-notification takes place 5 days in advance. Please ensure sufficient coverage; chargeback fees are at your expense.

(2) Payment via PayPal

Payment is made via PayPal (Europe) S.à.r.l. et Cie, S.C.A. (Luxembourg). During the ordering process, you will be taken to the PayPal payment page via a button. Detailed terms and conditions can be found at paypal.com/de/webapps/….

(3) Payment via Stripe

Payment is made via Stripe Payments Europe Limited (Ireland). During the ordering process, you will be taken to the Stripe payment page via a button. Details at stripe.com/de.

§ 5 Right of Retention & Reservation of Ownership

(1) Rights of retention can only be asserted from the same contractual relationship.

(2) The goods remain our property until the purchase price has been paid in full.

(3) Special regulations for resale and processing apply to entrepreneurs in addition.

§ 6 Warranty

(1) The statutory warranty rights apply.

(2) Consumers should check the goods for completeness, defects and transport damage upon delivery and report any complaints immediately. Otherwise, your legal claims remain unaffected.

(3) Deviations are only deemed to be agreed if they were expressly communicated before the contract was concluded.

§ 7 Choice of Law, Place of Performance, Place of Jurisdiction

(1) German law applies. The principle of favourability is maintained for consumers.

(2) The place of performance and jurisdiction is our registered office, provided the customer is not a consumer or does not have a residence in Germany/EU.

(3) The UN Sales Convention does not apply.
